Terms & Conditions
Prices and features.
Package prices can change at any time due to (and not limited to) changes in government
taxes, supplier prices, and currency fluctuations. Prices are guaranteed upon
receipt of full payment from the customer. MagicalHolidays.com (hereinafter referred
to as "MH") has the right to substitute features of equal or greater
value. Features offered by hotels, and other suppliers, may be changed at any
time by suppliers. All incidental costs not included in package prices are the
responsibility of the customer.
Flight schedules and airline seat assignments.
Flight schedules will be communicated to customers at the time of confirmation.
It is important for passengers to check with the appropriate airlines to reconfirm
their schedules prior to departure. Customers may also contact the airline to
request seat assignments. Advance seat assignment is offered by most airlines.
However, the number of seats available for advance assignment is limited and you
might receive your seat assignments at the airport. Contact the airline at the
number noted in the itinerary to reconfirm reservations and to receive current
schedule information.
Due to extended security procedures it is recommended that all passengers be at the airport at least 2 hours prior to departure.
Checked baggage limits.
A maximum of two checked pieces are allowed per passenger. The total linear dimension of each piece (height + width + length) may not exceed a total of 117 inches for domestic travel and 107 inches for International and Hawaii travel. Maximum single dimensions of the height, width or length of any piece may not exceed 62 inches. Maximum weight limit is 70 lbs. per checked piece.
Special note for air travel within International areas (such as intra-Europe): baggage allowances may vary significantly with respect to size and weight restrictions. Contact the airline for specific information.
Carry-on baggage limits.
One carry-on piece is allowed per passenger. The linear dimensions of the carry-on (height + width + length) may not exceed 45 inches. Maximum weight limit is 50 lbs. for domestic travel or 40 lbs. International and Hawaii travel.
Travel documents.
Virtually all documents will be forwarded via e-mail. However, when required, paper documents will be sent via U.S. mail or two-day delivery at least 10 days prior to trip departure date. If express delivery is required by the passenger (for example, if you are required to show a ticket to a foreign consulate prior to visa issuance) a $25 preparation fee per booking will be charged.
For travel within the United States: Passengers are required to carry at least one type of government issued photo identification.
For international travel: Passengers are required to carry a valid passport. Some
destinations require the addition of a visa issued by the foreign government.
It is the passenger's responsibility to check with the appropriate foreign government
consulates about travel requirements. Please visit the "Vacation Planning
Tools" page on this Web site for information and online links. The lack of
a passport at the time of departure will result in a denial of boarding of the
passenger.
Hotel check-in and special requests
Typical hotel check-in time is from early to mid-afternoon. Early morning or late evening check-in must be pre-arranged to guarantee room availability. Check-out time is usually from 11 a.m. to mid-day. Hotel room assignments are on a run-of-the-house basis (at the discretion of the hotel). Special requests made by customers are forwarded to the hotels and suppliers and are not guaranteed.
Incidental charges.
Incidental charges are items charged to your room such as meals, room service, telephone and laundry services. Incidental charges made by customers at hotels, and with other service operators, are the sole responsibility of the customer.
Payment and cancellation Information.
Full and non-refundable payment will be charged to the customer charge card upon
receipt of the reservation request from the customer. Charges are only processed
to the credit card upon confirmation of all services associated with the package
purchased. E-mail confirmations are sent by MH to the customer within 4 days
of the customer's reservation request.
Failure by the customer to provide a valid charge card, or failure of a particular charge to be approved, will result in the automatic cancellation of reservations. MH will advise the customer of such denial of credit charge via e-mail.
Reservation limits.
For reservations requested 21 days prior to departure a $35 per booking processing fee is charged. Reservations are not accepted less than 14 days prior to departure.
Travel insurance. Trip cancellation and interruption travel insurance is highly recommended.
If requested by the customer during the reservation process, MH will automatically
provide coverage and indicate fees for each passenger indicated on the itinerary
and confirmation. It is the passenger's responsibility to read the terms and
conditions of the contract provided by the insurance carrier made available
on the MH Web site. The travel documents sent via e-mail will include details

Disclaimer of Liability and notice of Responsibility.
These vacation packages are provided by MagicalHolidays.com (MH) and its contracted suppliers. MH is acting as a tour operator and is responsible for arranging the services provided in the travel packages described on the MH Web site and confirmed in writing to passengers. All participating suppliers providing transportation, sightseeing and services arrangements and lodging accommodations for MH, are independent contractors and are not employees of MH. All travel documents are subject to conditions as set forth by suppliers. Neither MH nor its agents shall be held liable for, and customer waives any claim against MH and its agents for any loss of or damage to property or injury to person caused by reason of any defect, negligence or other wrongful act or omission, of any other transportation company, lodging property, agency or any persons, rendering any of the services included in the vacation package. In no event shall any party be liable for consequential damages. MH is not responsible for any injuries, damages or losses caused to any traveler due to any terrorist activities, labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or any other actions or conditions outside the control of MH. MH will not be liable for late or non-delivery of documents and consequences thereof due to the fault of delivery or express carrier it chooses.
MH will do its utmost to substitute services of similar or higher quality whenever necessary. However, MH will not be liable for, and customer hereby waives any claim against MH, for any failure of performance by any other company, whether airline, hotel, sightseeing, or any other third party providing such services. MH reserves the right to decline, accept or retain any customer as a participant of these vacations at any time. If a vacation is canceled by MH we shall have no responsibility beyond the refund of all monies paid by the customer to MH.
It is agreed by and between the passenger and the operator that all disputes and matters whatsoever arising under or in connection with or incident to the responsibility of MH shall be litigated, if at all, in and before a court located in the state of New Jersey, USA, to the exclusion of the courts of any other state or country.
